Distance Selling Agreement
1. Parties
This Agreement is between Wearkids LLC (hereinafter referred to as "Seller"), with its registered address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, and the Customer (hereinafter referred to as "Buyer") who purchases digital educational gaming software (hereinafter referred to as "Product") via the website https://www.wearkids.shop.
2. Product Information
The Product sold by the Seller is digital educational gaming software, accessible via links provided to the Buyer upon completion of the purchase.
3. Payment
Payment for the Product is processed through Stripe. The Seller assures that the payment process adheres to the highest security standards. Prices listed on the website are final and inclusive of all taxes.
4. Delivery
Being a digital Product, there is no physical delivery. Upon successful payment, the Buyer will receive a link to access the Product in their user panel on the Seller's website.
5. Right of Access
The Buyer gains non-exclusive, non-transferable access to the Product upon purchase. This access is for personal, non-commercial use only.
6. Refund and Cancellation Policy
Due to the digital nature of the Product, refunds and cancellations are not available. However, the Seller commits to providing support to resolve any issues with accessing or using the Product.
7. Liability and Warranty
The Seller is not liable for any indirect, incidental, or consequential damages resulting from the use of the Product. The Product is provided 'as is' without any express or implied warranty.
8. Privacy Policy
The Seller commits to protecting the Buyer's personal data in accordance with applicable laws. Personal information collected during the transaction will be used solely for the purpose of completing the sale and providing access to the Product.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New Mexico. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Albuquerque, New Mexico.
